AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO BATTERY RECYCLING; AMENDING SECTIONS 14-150 THROUGH 14-153 OF THE BROWARD COUNTY CODE OF ORDINANCES ("CODE"); AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE.

A Resolution directing the County Administrator to publish notice of public hearing to consider enactment of the Ordinance was adopted by the Board of County Commissioners ("Board") at its meeting of November 13, 2025.

Summary Explanation/Background
On April 1, 2025, the Board enacted an Ordinance regulating the management and disposal of batteries within Broward County ("Battery Recycling Ordinance"). The Battery Recycling Ordinance prohibits the disposal of certain batteries and battery-containing products in regular trash or solid waste facilities. The Battery Recycling Ordinance also requires that certain battery retailers establish free, on-site collection programs for recycling or disposing of used batteries and display signage informing consumers about safe recycling.
Since the Battery Recycling Ordinance was enacted, industry stakeholders have provided feedback and suggested certain minor modifications. The proposed Ordinance incorporates this feedback.
If enacted, the proposed Ordinance would: (1) include both batteries and rechargeable battery products in the gross revenue threshold that subjects retailers to the Battery Recycling Ordinance; (2) modify standards for signage, including visibility, placement, and content ...
