A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, REPEALING SECTIONS 22.175 THROUGH 22.177 OF THE BROWARD COUNTY ADMINISTRATIVE CODE ("ADMINISTRATIVE CODE"), RELATING TO THE BROWARD COUNTY PROPERTY ASSESSED CLEAN ENERGY ("PACE") PROGRAM REQUIREMENTS; AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE ADMINISTRATIVE CODE, AND AN EFFECTIVE DATE.

A Resolution directing the County Administrator to publish notice of public hearing to consider adoption of the Resolution Amending the Broward County Administrative Code was adopted by the Board of County Commissioners ("Board") at its meeting of May 21, 2024.

Summary Explanation/Background
Section 163.08, Florida Statutes, established Florida's Property Assessed Clean Energy ("PACE") program, which allows property owners to apply to PACE program administrators to finance certain energy efficiency, renewable energy, and wind resistance improvements. Broward County adopted various consumer protections as conditions to PACE program administrators being permitted to enter into financing agreements with residential property owners, including disclosure and income-based requirements. Those consumer protection standards are currently promulgated in various locations in the Broward County Administrative Code ("Administrative Code") and the Broward County Code of Ordinances ("Code").
