AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO THE TAX COLLECTOR; CREATING SECTION 311/2 5 OF THE BROWARD COUNTY CODE OF ORDINANCES ("CODE"); AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE.

Summary Explanation/Background
Pursuant to a recent amendment to the Florida Constitution, a newly elected Tax Collector took office earlier this year. Florida law states that the Tax Collector shall provide a bond in the amount set by the Board, and that the Board may consider the amount of money likely to be in the custody of the Tax Collector when setting the amount.
When tax collector duties were performed by the County, the Board had set the bond amount at $300,000 each for the Director of Finance and Administrative Services Department ("FASD") and the Director of the Records, Taxes, and Treasury Division. FASD recommends the Board set the same bond amount for the elected Tax Collector, namely $300,000. As requested by FASD, the Ordinance also permits evidence of substantially equivalent insurance, as determined by the Director of the Risk Management Division, in lieu of the bond. FASD indicates that the County's current insurance policies provide substantially equivalent coverage.
