Summary Explanation/Background

Recently, a County employee served on an evaluation committee despite a potential conflict of interest. The employee properly disclosed the potential conflict but nonetheless was appointed to and served on the evaluation committee. At a minimum, such service creates questions about the fairness and objectivity of County procurements. To ensure this does not occur again, this item directs the County Attorney’s Office to prepare an amendment to the applicable code provision for future consideration by the Commission that would provide that an employee with a known actual or apparent conflict of interest may not serve on an evaluation committee and would be subject to disciplinary action, up to and including termination, if they do serve on an evaluation committee despite a known conflict of interest.
