Summary Explanation/Background
THE PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT AND THE ENVIRONMENTAL PERMITTING DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.
On February 7, 2011, the Public Works and Environmental Services Department issued Environmental Resource License (ERL) No. DF04-1223 for the development of "Davie Estates." On March 16, 2010, and prior to the issuance of ERL No. DF04-1223, the licensee recorded a Conservation Easement (OR Bk. 46944, Pg. 1378), shown in Exhibit 1, without the review and approval of the County Attorney's Office or acceptance by the Commission. The Conservation Easement (Exhibit 1) was granted to Broward County and the South Florida Water Management District (SFWMD).
The ERL No. DF04-1223 expired without any wetland impacts occurring to the site. Further, the Conservation Easement conflicts with future development plans. On September 17, 2025, a new ERL (No. DF21-1057) was issued which authorized impacts to 18.32 acres of wetlands on site. Mitigation was provided through 3.9 credits purchased from the Everglades Mitigation Bank and 0.36 credits from the Pembroke Pines Mitigation Bank (fka Florida Wetlands Bank Mitigation Bank).
