AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO NOISE; AMENDING VARIOUS SECTIONS OF ARTICLE VII OF CHAPTER 27 OF THE BROWARD COUNTY CODE OF ORDINANCES (“CODE”) RELATING TO NOISE GENERATED BY FACILITIES AUTHORIZED TO OPERATE WITH A BROWARD COUNTY AIR LICENSE OR STATE OF FLORIDA AIR PERMIT; AMENDING SECTION 39-133 OF THE CODE RELATED TO NOISE DISTURBANCES; AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE.

Summary Explanation/Background
The proposed Ordinance amends various sections of Article VII of Chapter 27 of the Broward County Code of Ordinance (“Code”) to limit the regulation of excessive noise to apply only to facilities with a Broward County air license or State of Florida air permit. The proposed Ordinance further amends Section 39-133 of the Code to allow noise complaints originating from the Broward Municipal Services District neighborhoods to be addressed as a public nuisance.
