MOTION TO DIRECT County Attorney's Office to draft a Resolution amending (i) Part XXXIII, Tree Preservation Trust Account, of Chapter 27 of the Broward County Administrative Code ("Administrative Code") to authorize the County Administrator to execute agreements for disbursements from the Tree Preservation Trust Fund in a form subject to review and approval as to legal sufficiency by the County Attorney's Office; and (ii) to create Part XXXI of Chapter 27 of the Administrative Code to authorize the County Administrator to execute agreements related to Unsafe Structures, Guaranteed Partial Service, Non-guaranteed Partial Service, Building Code Enforcement, and Zoning Code Enforcement in a form subject to review and approval as to legal sufficiency by the Office of the County Attorney.

Direction by the Board of County Commissioners ("Commission") is required for the County Attorney's Office to draft a Resolution amending the Broward County Administrative Code ("Administrative Code").

THE PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT AND THE BUILDING CODE DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.
Section 27.187 of the Administrative Code authorizes specified disbursements from the County's Tree Preservation Trust Fund, which are currently memorialized through Tree Trust Agreements. Under the current process, Tree Trust Agreements require Commission approval.
