Summary Explanation/Background

THE PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT AND THE HOUSING AND URBAN PLANNING DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

The applicant, PVL VII, LLC, requests termination and release of the Declaration of Restrictive Covenants recorded in Book 10302, Page 521, of the Broward County Official Records, originally tied to a 1982 Land Use Plan Amendment. On August 17, 2023, a new Declaration governing said entitlements for the property was recorded under Instrument Number 119047640 in connection to Land Use Plan Amendment PC 23-01, which remains in full force and effect.

 

Staff recommend approval of the applicant’s request, and the termination and release has been approved as to form by the Office of the County Attorney (Exhibit 3).
