Summary Explanation/Background
THE RESILIENT ENVIRONMENT DEPARTMENT AND URBAN PLANNING DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.
The City of Dania Beach requests to ratify an amendment to the Tri-Party Education Mitigation Agreement in connection with Broward County Land Use Plan Amendment (LUPA) PCT 22-07. The Board approved the LUPA on February 6, 2024, which added 4,000 dwelling units to the Dania Beach Activity Center. This request updates the current School Mitigation Agreement to be consistent with the LUPA. It requires the developer(s) of new dwelling units to pay school impact fees at time of permit issuance.
City of Dania Beach and the Broward County School Board have executed the amendment (Exhibit 3). The Broward County Planning Council has no objection to this request and has submitted additional information for the Board's consideration regarding the need for such agreements (Exhibit 4).
Staff recommends approval of the applicant's request, and the agreement has been approved as to form by the Office of the County Attorney.
