Summary Explanation/Background

THE FINANCE AND ADMINISTRATIVE SERVICES DEPARTMENT AND THE RISK MANAGEMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

On December 26, 2018, the Claimant, a former restaurant manager, sustained injuries during the course and scope of employment with the Broward County Performing Arts Center. The Claimant alleged injuries to the low back during a slip and fall while walking through the kitchen.

 

Through negotiations with the Claimant, a settlement was reached in the total amount of $147,600. This amount is broken down as follows: (1) The Claimant will receive $110,375 plus $100 for a General Release and Resignation Agreement; and (2) The Claimant’s attorney will receive $36,875 for fees and $250 for costs. The settlement includes all past and future indemnity and medical benefits.

 

The County Administrator and the County Attorney are both in agreement with the settlement in order to mitigate future financial exposure to the County.
