MOTION TO ENACT Ordinance, the title of which is as follows:
AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO THE BROWARD COUNTY LOCAL PROVIDER PARTICIPATION FUND ORDINANCE; AMENDING ARTICLE V OF CHAPTER 16 OF THE BROWARD COUNTY CODE OF ORDINANCES ("CODE"); UPDATING THE ASSESSMENT STRUCTURE TO ADDRESS PROPOSED CENTERS FOR MEDICARE & MEDICAID SERVICES WAIVER-RELATED HOSPITAL EXEMPTIONS; AUTHORIZING THE USE OF ASSESSMENT PROCEEDS FOR ADDITIONAL MEDICAID SUPPLEMENTAL PAYMENT PROGRAMS; AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE.

Summary Explanation/Background
The Broward County Local Provider Participation Fund Ordinance ("LPPF Ordinance"), as set forth in Article V of Chapter 16 of the Broward County Code of Ordinances, authorizes the Board to impose a uniform non-ad valorem special assessment upon local private hospital properties in Broward County ("Assessment") pursuant to the Medicaid Managed Care hospital directed payment program administered by the State of Florida. The Assessment funds a portion of the nonfederal share of Medicaid supplemental payment programs administered by the State. In 2024, the Board amended the LPPF Ordinance to authorize the use of Assessment proceeds for supplemental payments under the Low Income Pool Program.
