Why Action is Necessary

Direction by the Board of County Commissioners (“Commission”) is required for the County Attorney’s Office to draft an Ordinance amending the Broward County Code of Ordinances (“Code”) and a Resolution amending the Broward County Administrative Code (“Administrative Code”).

Summary Explanation/Background

This item would direct the County Attorney’s Office to prepare amendments to the Code and the Administrative Code to make the following modifications to nonconsent towing rates and regulations:

• Increase the annual escalator for nonconsent towing rates to the lesser of the Consumer Price Index (“CPI”) or 5% (currently the lesser of CPI or 3%);

• Provide a surcharge for electric vehicle storage due to fire risk;

• Permit a fuel surcharge comparable to that permitted for taxicabs; and

• Require Level 1 background checks for towing company employees.

This item is submitted after the deadline for supplemental items because the issue was only recently raised to the Mayor’s attention. This item cannot be timely considered at the following Commission meeting because the proposed modifications should be incorporated in the upcoming October 1, 2026, annual increase.
