Title: MOTION TO DIRECT Office of the County Attorney to draft, in consultation with County staff, a proposed Resolution amending the Broward County Administrative Code ("Administrative Code") to (i) establish a reasonable application fee for the submission of an unsolicited proposal under Section 255.065, Florida Statutes (the "Statute"), and (ii) authorize the County Administrator to take any and all actions permitted under the Statute with respect to the reasonable application fee, including but not limited to requesting the proposer to submit an additional amount when the County Administrator determines that the standard codified application fee is insufficient to cover the County's costs to evaluate the unsolicited proposal.

Summary Explanation/Background
Pursuant to Section 255.065, Florida Statutes (the "Statute"), the County is authorized to establish a reasonable application fee for the submission of an unsolicited proposal. Upon the establishment of a reasonable application fee, any private entity that submits an unsolicited proposal to the County is required to pay such fee concurrently with the submission of the unsolicited proposal. If the fee paid would not cover the County's costs to evaluate the unsolicited proposal, the proposed Administrative Code amendment would also authorize the County Administrator to request payment of an additional amount and require the submitting entity to pay such additional amount within thirty (30) days.
