Summary Explanation/Background

Section 102.141, Florida Statutes, provides that "[t]he county canvassing board shall be composed of the supervisor of elections; a county court judge, . . . ; and the chair of the board of county commissioners." The statute provides that if the chair (here, the Mayor) is unable to serve or is disqualified, the Board of County Commissioners shall appoint another County Commissioner as a substitute. In addition, Section 102.141 requires the Mayor to appoint an additional County Commissioner to serve as an alternate member of the Canvassing Board to serve in the event the regular or substitute member is unable to participate in a particular canvassing board meeting.

 

Section 18.33 of the Broward County Administrative Code provides that if the Mayor is ineligible to serve on the Canvassing Board, then the Vice-Mayor shall serve; and if the Vice-Mayor is ineligible to serve, then the duty passes to the other County Commissioners by order of district number.  If the Mayor is ineligible to serve and the Board determines another County Commissioner is willing and able to serve, the Board may waive this provision and appoint the eligible County Commissioner.

 

For the 2020 elections, Mayor Holness is an active participant in the elections being canvassed and therefore is ineligible to serve on the Canvassing Board. At the Board's December 10, 2019, meeting, Commissioner Udine expressed an interest in serving as a member of the Canvassing Board for calendar year 2020. Commissioner Udine has served as a member of the Canvassing Board since the March 2019 election and has completed the required training.

 

This item, if approved, would adopt the proposed Resolution to waive Section 18.33 of the Broward County Administrative Code and appoint Commissioner Udine to serve as the substitute member of the Canvassing Board for calendar year 2020. 

 

In addition, at the Board's December 10, 2019, meeting, Commissioner Fisher, who has served as an alternate on the Canvassing Board since January 2019, indicated his willingness to continue to serve in that capacity for calendar year 2020. Motion B of this item notes for the record that Mayor Holness has appointed Commissioner Fisher to serve as an alternate member of the Canvassing Board for calendar year 2020.
