MOTION TO APPROVE formula grant award from the U.S. Department of Justice (DOJ), Bureau of Justice Assistance (BJA), in the amount of $136,649, for the 2019 State Criminal Alien Assistance Program (SCAAP), and authorize the County Administrator to take all administrative and budgetary actions necessary to implement the award.

B. MOTION TO ADOPT budget Resolution No. 2020-057 within the BSO DOJ Grant Fund, 70500, in the amount of $136,649.

Why Action is Necessary
In accordance with Broward County Code, Chapter 1, Section 1-20, action by the Broward County Board of County Commissioners is necessary to accept grant awards.
What Action Accomplishes
Funds pass to BSO and may be used for a variety of services including training/education for offenders, training for correctional officers to help manage the inmate population, mental health services, medical services, technology/communications, and workforce recruitment and retention.

Summary Explanation/Background
SCAAP is a formula grant that determines the award based on eligible prison population during a specific period. In this case, the formula takes into account the number of undocumented criminal aliens that were incarcerated in Broward jails during 2018, information provided by applicant governments (in this case BSO) in online applications, Department of Homeland Security review of data on eligible inmates, and the amount of federally-appropriated funds available in the given cycle. There is no line item budget included in this application.
The award has come to the County due to recent DOJ changes in eligibility, specifically for recipients of BJA funds. Previously, BSO applied for these funds directly and was deemed an eligible applicant; however, under the new definition, only units of local government are eligible to apply. The definition now states: “Unit of local government” means a political subdivision of a State with authority to independently establish a budget and impose taxes. The term may include a county or a municipality (e.g., city, county, town, township, village, borough, or parish). Note: A department or agency that is part of such a unit of local government is not itself considered a unit of local government. BSO will be the implementing agency.
