Summary Explanation/Background

CULTURAL DIVISION RECOMMENDS APPROVAL OF THE ABOVE MOTION.

 

This item supports the Board's value of cultivating community culture, arts, recreation, and life-long learning and goals relating to providing diverse artistic, cultural, educational, and historical amenities and programs that contribute to a vibrant, multi-cultural, and economically viable community.

 

Ms. Janet Erlick, President, Corporate Secretary and Executive Artistic Director of FLCT, is also a member of the Broward Cultural Council, an advisory board of the Broward Cultural Division.

 

The FLCT receives funding from Broward County through the Broward Cultural Division’s Cultural Investment Program and provides both contractual and non-contractual arts integration and education program services.

 

Pursuant to Section 112.313(3), Florida Statutes, a public officer  . . . acting in a private capacity [must not] rent, lease, or sell any . . .  services to the officer’s . . .  own agency.   However, Section 112.313(12) provides that where a conflict exists under 112.313(3), the appointing authority, in this case the Board of County Commissioners, may waive such conflict upon a two-thirds vote of the appointing authority. Prior to taking the vote, the public officer must provide a full disclosure of the conflict by filing a form 4A. Ms. Erlick’s form 4A is attached hereto as Exhibit 1.
