MOTION TO DIRECT Office of the County Attorney to draft an Ordinance amending the Capital Improvements Element (CIE) of the Broward County Comprehensive Plan, BrowardNEXT2.0, specifically amending Objective CI1 and related Policies CI1.11 and CI1.14 to reflect a new Table CI-O that contains the Transportation Surtax projects, as well as adding the adopted 2020 schedule of capital improvements of the Board of County Commissioners and the Broward Metropolitan Planning Organization to meet statutory requirements.

Why Action is Necessary
Section 163.3184, Florida Statutes (F.S.) requires the enactment of an Ordinance during a public hearing to adopt comprehensive plan amendments. Section 163.3177(3)(b), F.S. requires that the local five-year capital improvements schedule be updated in the CIE annually. Policy CI1.14 of the County’s Capital Improvements Element requires the County to add projects that will be funded through Transportation Surtax, approved by the electorate on November 6, 2018, to the CIP by Fiscal Year 2020.

Summary Explanation/Background
THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT AND THE PLANNING AND DEVELOPMENT MANAGEMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.
Section 163.3177(3)(b), F.S. requires that the Capital Improvements Element be reviewed every year and that the local five-year capital improvements schedule be updated in the CIE, including the Metropolitan Planning Organization’s (MPO) adopted transportation improvements.
On March 28, 2019, the Board of County Commissioners adopted the BrowardNEXT2.0 Comprehensive Plan, including the Broward Municipal Services District (BMSD) Element and Future Land Use Map Series, which includes the Capital Improvement Element and tables CI-A through CI-N of the capital improvements program (CIP). The CIP tables in the CIE also include the Broward MPOs adopted transportation improvements.
In September 2019, the Board of County Commissioners adopted the 2020 annual budget, including the CIP and a new table that outlines the projects that will be developed using the Transportation Surtax funds that were adopted by County referendum in 2018. This amendment adds a new table in this year’s annual adoption of the CIP as Table CI-O - Transportation Surtax, as well as updates several references to the tables in policies of the CIE.
