Why Action is Necessary

In accordance with the Broward County Procurement Code, Section 21.31.a.4, Award Authority, Board approval is required for awards exceeding $500,000. The contract threshold increase exceeds the authority of the Director of Purchasing.

Provides additional funding threshold for general roadway and miscellaneous construction at various Broward County locations for the remaining term of the contract.

Summary Explanation/Background

THE PURCHASING DIVISION AND THE PUBLIC WORKS DEPARTMENT/HIGHWAY AND BRIDGE MAINTENANCE DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

The Office of Economic and Small Business Development (OESBD) established a County Business Enterprise (CBE) goal of 30% for this contract. DP Development of the Treasure Coast, LLC committed to 30.2% CBE participation, which the OESBD reviewed and approved.

 

In accordance with the Broward County Workforce Investment Program, Broward County Administrative Code, Section 19.211, these services are subject to the Workforce Investment Program. DP Development of the Treasure Coast, LLC agreed to be bound to the contractual obligations of the Workforce Investment Program.

 

The purpose of this contract is to provide general roadway and miscellaneous construction for the Highway and Bridge Maintenance Division and various Broward County agencies that are in need of these services, which include roadway milling, resurfacing, pavement marking, miscellaneous pavement repair activities, drainage repair work, traffic control and signalization, landscaping, signing and pavement marking, guardrail, maintenance of traffic and miscellaneous maintenance activities.

 

The allowances incorporated into this contract are in the amount of $700,000, which include the following: $80,000 for irrigation system; $200,000 for unforeseen conditions; $200,000 for parts and materials; $200,000 for specialized construction activities; $10,000 for permit fees for non-Broward County agencies; $10,000 for Security Services.

 

On March 15, 2019, after notice to the Board, the contract was awarded by the Director of Purchasing to DP Development of the Treasure Coast, LLC in the estimated annual not-to-exceed amount of $11,458,07 for a one-year initial term, including two one-year renewals in the three-year potential estimated amount of $34,374,210. The contract began on March 15, 2019 and is due to expire March 14, 2020.

 

As of January 15, 2020, the current expenditures on the contract were $11,615,494.

 

On January 17, 2020, the Highway and Bridge Maintenance Division requested to increase the contract threshold in the amount of $3,600,000 for its Division and various Broward County agencies that utilize this contract. In order to complete some of the existing repairs already underway, the Director of Purchasing approved a $400,000 threshold increase which is within the delegated approval authority and the remaining amount of $3,200,000 is being requested for approval through this agenda item.
