B. Board of County Commissioners’ approval is required pursuant to Florida case law for conveyance of interest in property to Broward County.

Summary Explanation/Background
PUBLIC WORKS DEPARTMENT/HIGHWAY CONSTRUCTION AND ENGINEERING DIVISION RECOMMENDS APPROVAL.
South Andrews Avenue is a County road located in the City of Fort Lauderdale.
Motion A will allow Elevate One River LLC and the City of Fort Lauderdale to install improvements along the west side of South Andrews Avenue south of West Las Olas Boulevard. The proposed improvements include pedestrian level light poles, decorative pavers, decorative tree grates, landscaping and irrigation. The landscaping improvements shall incorporate a minimum 50% native species by plant types and shall follow the Broward County NatureScape program and Florida-Friendly Landscaping principles. Elevate One River LLC will be obligated to maintain these improvements. In the event that Elevate One River LLC fails to maintain these improvements, the City of Fort Lauderdale is obligated to perform maintenance. The agreement also allows the County to terminate the agreement with or without cause at any time. If the agreement is terminated, Elevate One River LLC must remove all improvements within the licensed right-of-way and restore the area to its original condition.
Motion B will convey an irregularly-shaped road easement, measuring approximately nine feet by 195 feet, from Elevate One River LLC to Broward County. The parcel is located along the west side of South Andrews Avenue south of West Las Olas Boulevard. The easement is required to allow future maintenance and repair of the Andrews Avenue Drawbridge.
The Resolution and road easement have been reviewed and approved as to form by the County Attorney’s Office.
The Agreement has been reviewed and approved as to form by the County Attorney’s Office and the Risk Management Division.
