In accordance with the Broward County Procurement Code, Section 21.31.a.4, Award Authority, Board approval is required for awards exceeding $500,000 that includes a single bidder, rejection of apparent low bidder, or protested award.

Provides for the construction of new additional parking for Broward County Central Broward Regional Park (now known as Central Broward Park & Broward County Stadium).

Summary Explanation/Background
THE PURCHASING DIVISION AND THE PARKS AND RECREATION DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.
The Office of Economic and Small Business Development (OESBD) established a County Business Enterprise (CBE) goal of 35% for this contract. H.G. Construction, Development and Investment, Inc. committed to 35% CBE participation, which has been reviewed and approved by the OESBD (Exhibit 3).
In accordance with the Broward County Workforce Investment Program, Broward County Administrative Code, Section 19.21, these services are subject to the Workforce Investment Program. H.G. Construction, Development and Investment, Inc. has agreed to be bound to the contractual obligations of the Workforce Investment Program.
The contract provides for construction of the additional parking at the Central Broward Park & Broward County Stadium.
This procurement carries a 100% performance and payment guaranty. The Purchasing Division confirmed with the surety company that H.G. Construction, Development and Investment, Inc. has the capacity to obtain the required guaranty.
The low bidder, Top Crafts, Inc., is non-responsive to the bid requirements; the bidder did not meet the CBE requirements as stated in the bid documents. The CBE goal was established at 35% participation; Top Crafts, Inc. committed to 19.42% participation goal. The difference in cost between the low bidder and the recommended bidder is $9,216.
The low responsive, responsible bidder, H.G. Construction, Development and Investment, Inc. is a non-local business; the second and third low responsive, responsible bidders, Sagaris Corp. and Florida Blacktop, Inc. respectively, are local businesses and bid amounts were within 10% of the non-local bidder's bid amount. Therefore, in accordance with the Local Preference Ordinance, the Best and Final Offer (BAFO) process was extended to H.G. Construction, Development and Investment, Inc. (a non-local business), Sagaris Corp. (local business) and Florida Blacktop, Inc. (local business). Three BAFO responses were received, and the award is being recommended to the low bidder, H.G. Construction, Development and Investment, Inc. (Exhibit 2).
The best and final offer has extended the bid validity to April 27, 2020.
Highway Construction and Engineering Division reviewed the bid submitted by H.G. Construction, Development and Investment, Inc. and concurs with the recommendation for award (Exhibit 4). There are no performance evaluations for H.G. Construction, Development and Investment, Inc.
There is no protest or appeal filed regarding this procurement.
The bid posted on July 24, 2019 and opened on September 11, 2019; eight bids were received with one declination (Exhibit 1).
