MOTION TO AWARD fixed contract to low responsive, responsible bidder, Primus Construction Services, Inc., for Renovation of Boulevard Gardens Community Center, Bid No. PNC2119537C1, for the Highway Construction and Engineering Division in the amount of $711,600, which includes an allowance of $10,000, to be substantially completed within 240 calendar days from the Project Initiation Date listed in the second Notice to Proceed for construction, contingent upon the receipt and approval of insurance/performance and payment guaranty; and authorize the Mayor and Clerk to execute same. (Commission District 9)

Why Action is Necessary
Motion A: Pursuant to Broward County Administrative Code Section 20.24(f)(4)(d), approval of the Board is required to increase an approved capital project by 5% or more.
Motion B: In accordance with the Broward County Procurement Code, Section 21.31.a.4, Award Authority, Board approval is required for awards exceeding $500,000 that includes a single bidder, rejection of apparent low bidder, or protest award.
What Action Accomplishes
Motion A: Amends the budgets within the Fiscal Year 2020 Broward Municipal Services District Capital Fund for the Boulevard Gardens Community Center renovation project.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE PUBLIC WORKS DEPARTMENT/HIGHWAY CONSTRUCTION AND ENGINEERING DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.
The Office of Economic and Small Business Development (OESBD) designated this project as a reserved project for County Business Enterprise (CBE) firms. The OESBD determined that Primus Construction Services, Inc. meets the eligibility criteria of the CBE Reserve Program (Exhibit 2).
The purpose of this contract is for renovation of the Boulevard Gardens Community Center and site improvements at the park.
The allowance incorporated in this contract, in the amount of $10,000, is for non-County agency permits and fees. Expenditures under this allowance item must be approved by the Contract Administrator and will be reimbursed at the contractor’s actual incurred cost, without mark-up.
This procurement carries a 100% performance and payment guaranty. The Purchasing Division confirmed with the surety company that Primus Construction Services, Inc. has the capacity to obtain the required guaranty.
The Director of Purchasing determined the apparent low bidder, S3S Construction, Inc., to be non-responsive based on the OESBD findings that the bidder was non-compliant with the CBE Reserve Program requirements of the solicitation (Exhibit 2). The delta between the low bidder and the second bidder is $39,445.
The Highway Construction and Engineering Division, Parks Planning and Design Section, reviewed the bid submitted by Primus Construction Services, Inc. and concurs with the recommendation for award (Exhibit 3). Two performance evaluations were completed for Primus Construction Services, Inc.; the firm has an overall rating of 4.35 out of a possible 5.0. Copies of the vendor’s performance evaluations are available upon request.
The prices submitted are fair and reasonable based on the engineer’s project estimate (Exhibit 4).
There was no protest or appeal filed regarding this procurement.
The bid validity for this project expires on March 19, 2020. Primus Construction Services, Inc. agreed to extend its bid validity through project award.
The bid posted on October 18, 2019 and opened on November 20, 2019; three bids were received with no declinations (Exhibit 1).
