Why Action is Necessary
Pursuant to Chapter 32, Part II, Section 32.25 of the Broward County Administrative Code, the Port Everglades Department Business Administration Division is required to conduct franchise evaluations annually, on a rotating basis, in such a manner whereby all franchises are reviewed within a two-year period and file a Final Franchise Evaluation Report with the Board.

Summary Explanation/Background
Chapter 32, Part II, Section 32.25 of the Broward County Administrative Code ("Code") requires the County, through the Port Everglades Department Business Administration Division, to conduct franchise evaluations annually, on a rotating basis, in such a manner whereby all franchises are reviewed within a two-year period to determine if each franchisee continues to satisfactorily meet the terms and conditions of its franchise. The Code also requires a Final Franchise Evaluation Report (“Report”) to be filed with the Broward County Board of County Commissioners’ (“Board”) within 60 days following completion of the Report. The Port Everglades Department Business Administration Division completed the Report on February 14, 2020 (see "Exhibit 1").
The Report covers the activities of 33 franchises (listed alphabetically) during the two-year period from July 1, 2017, through June 30, 2019. A total of 22 companies are represented, as several companies have multiple franchises. Franchise categories include stevedore, cargo handler, steamship agent, tugboat or towing concern, vessel bunkering service, vessel oily waste removal service, vessel sanitary waste water removal service, and marine terminal security service.
Each franchisee was given written notice of the franchise review and requirement to update the application information via a questionnaire (see "Exhibit 2"). In addition to the information submitted by franchisees, additional information and input was received from each Port Everglades Department Division and from the Port’s Franchise Manager. Further input was received from the Broward County Department of Environmental Protection and Growth Management ("DEPGM"), the Broward County Risk Management Division, the U.S. Coast Guard ("USCG"), the Florida Department of Environmental Protection ("FDEP"), the Florida Department of Transportation ("FDOT"), U.S. Customs and Border Protection ("CBP"), and the U.S. Occupational Safety and Health Administration ("OSHA").
Staff has concluded that each of the responding franchisees has satisfactorily met the terms and conditions of its franchise and does not have a delinquent payment history with Broward County.
Completed questionnaires and all supporting documents are on file in the Port Everglades Business Administration Division’s office.
