Section 163.3184(11), Florida Statutes, requires Broward County to publish notice of public hearings to adopt comprehensive plan amendments.

On November 5, 2019 the Board of County Commissioners transmitted the proposed amendment to the designated state review agencies (Item 63).

 

Summary Explanation/Background

THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT (EPGMD), THE LOCAL PLANNING AGENCY (LPA), AND THE PLANNING AND DEVELOPMENT MANAGEMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

South Florida Water Management District (SFWMD) approved the 2018 Lower East Coast Regional Water Supply Plan update on November 8, 2018; the final administrative order was issued on January 11, 2019.  Therefore, consistent with State law, Broward County must adopt its Water Supply Facilities Work Plan (“Work Plan”) by May 2020. 

 

As part of the Work Plan update, staff recommends amending Policies WM2.1 and WM3.1 of the Water Management Element in the Broward County Comprehensive Plan. Policy WM2.1 (shown in Exhibit 3 - Attachment A), adopts the County’s Work Plan by reference, provides for its inclusion in the Water Management Element, requires regular updates, and inclusion of short-term projects in the Capital Improvements Plan. The County’s Work Plan is attached (Exhibit 4).

 

On September 18, 2019, the EPGMD LPA recommended that the Board find the proposed Amendment 20-T1 consistent with the Broward County Comprehensive Plan and transmit the amendment to the designated state review agencies. On November 5, 2019 (Item 63) the Board transmitted the proposed amendment to the designated state review agencies, who responded within the 30-day time frame. Only South Florida Water Management District (SFWMD) provided comments, which have been added to the Staff Report (Exhibit 1). In response, staff have edited proposed language in the WSFWP (Exhibit 4), and in Water Management Element Policies WM2.1 and WM3.1 (as shown in Attachment A to Exhibit 3).  Proposed changes transmitted to State and Regional Agency for review shown with single-underline and strikeouts.
