Summary Explanation/Background

THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT AND THE PLANNING AND DEVELOPMENT MANAGEMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

The Planning and Development Management Division has received a request to vacate a 25-foot right-of-way as recorded in Deed Book 699, Page 233, located at 400 Southwest 27 Avenue in the City of Fort Lauderdale. Vacating this right-of-way will provide clear and unencumbered title to the property owner.

City approval was not required for this request due to the County being the recipient of the deeded right-of-way and public interest was deemed unaffected. Review of this application by the applicable reviewing agencies indicates that there is no objection to the abandonment and vacation of the subject right-of-way.

On January 27, 2020, the land encumbered by the easement was sold by Clarkson-Bergman Family Partnership, LTD to Riverland Owner, LLC. Exhibit 1 has been updated to reflect the change of ownership.

This vacation application has been reviewed and approved as to form by the Office of the County Attorney.
