Summary Explanation/Background

THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT AND THE PLANNING AND DEVELOPMENT MANAGEMENT DIVISION RECOMMEND APPROVAL, subject to staff recommendations and conditions which will assure compliance with the standards and requirements of Chapter 5, Article IX of the Broward County Code of Ordinances.

 

Lyons and Sample Road Plat is located on 22.5 acres on the northeast and northwest corners of Sample Road and Lyons Road, in the City of Coconut Creek.

 

The applicant is requesting to amend the Agreement for Amendment of Notation on Plat granted in March 20, 2018 by County Commission, recorded under instrument number 115090927, which amended the plat note to 200,000 square feet of commercial use on Tract A and service station/convenience store with 16 fueling positions on Tract C.

 

Pursuant to Broward County Code Section 5-181(o), findings of adequacy expire five years after Board approval of a plat application. Staff Report approved by the Board on March 20, 2018 granted only four years for the findings of adequacy. This date was included in the Agreement for Amendment of Notation on Plat (instrument number 115090927). This item extends the findings of adequacy to reflect the full five year expiration date of March 20, 2023.

 

The applicant has also filed for an extension to the findings of adequacy based on Governor’s Executive Order 19-189 due to Hurricane Dorian which would grant a “60 day and six month” extension in accordance with Florida Statute 252.363. Therefore, extending the final date for the findings of adequacy to November 19, 2023.
