Why Action is Necessary

In accordance with the Broward County Procurement Code, Section 21.47, Amendments, Board approval is required for contract amendments when the cumulative total amount of which is greater than execution authority.

 

What Action Accomplishes

Amendment No. 2 will provide the addition of elevator and escalator modernization and pass-thru allowance increase to allow for needed retrofit of four failing critical elevators at four locations within the Port Everglades Department and required parts and materials through the term of the contract.

Summary Explanation/Background

THE PURCHASING DIVISION AND THE PORT EVERGLADES DEPARTMENT RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

On March 5, 2019 (Item No. 36), the Board awarded open-end Contract No. BLD2116389B1 to Oracle Elevator Holdco, Inc. for Elevator and Escalator Maintenance and Repair Services at Port Everglades. The contract commenced on February 1, 2019 for an initial two-year period at an estimated two-year amount of $1,913,800, which included allowances in the amount of $126,000, with three one-year renewal options for a total potential five-year estimated contract amount of $4,784,500.

 

Expenditures to date: $1,107,760.

 

On June 5, 2019, as the result of a merger, a name change was filed with the state of Florida changing the name Oracle Elevator Company to Oracle Elevator Holdco, Inc.

 

On December 31, 2019, the Port Everglades Department (Port) submitted its request to amend the contract in the total amount of $1,200,000 for the reasons of: 1) adding ten elevators and escalators at Terminal No. 25 to the contract for preventive maintenance services beginning October 1, 2019; 2) increasing allowances for parts and materials and permit pass-thru due to the high instances of repairs unanticipated at the time of the original solicitation; and 3) addition of modernization services to retrofit four failing critical elevators at four Port locations (Exhibit 1).

 

Amendment No. 1 to Contract No. BLD2116389B1 is pending retroactive approval by the Director of Purchasing to add the ten elevators and escalators at Terminal No. 25 for preventive maintenance services from October 1, 2019 through the end of the initial two-year term in the amount of $94,240, plus the three one-year renewals in the total amount of $212,040; and approved the threshold increase for the allowance pass-thru amount for parts and materials in the amount of $93,720 for a total amendment amount of $400,000.

 

Amendment No. 2 to Contract No. BLD2116389B1 will provide for the addition of modernization services for four separate projects to retrofit elevators at four Port locations. These projects are scheduled to commence during the initial term of the contract, which expires on January 31, 2021. Total amount for the four projects is $474,870. The Port has also requested an increase to the allowance pass-thru amount for parts and materials and permits in the amount of $325,130. The total amount for Amendment No. 2 is $800,000.
