Why Action is Necessary

Motion A. In accordance with the Broward County Procurement Code, Section 21.34, Sole Source Procurement, Board approval is required for awards exceeding the Director of Purchasing’s authority.

 

Motion B. In accordance with the Broward County Procurement Code, Section 21.31.a.4, Award Authority, Board approval is required for awards exceeding $500,000 that include a single bidder, rejection of apparent low bidder, or protested award.

Summary Explanation/Background

THE PURCHASING DIVISION AND THE PUBLIC WORKS DEPARTMENT/TRAFFIC ENGINEERING DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.

 

The purpose of this contract is to provide adaptive traffic signal control replacement equipment and repairs for ten intersections only along the Pines Boulevard corridor that have the InSync adaptive traffic signal control equipment and parts; that have been procured by the Florida Department of Transportation (FDOT); and were installed in 2018. According to Section 603-2.1 of the FDOT General Requirements for Traffic Control Signals and Devices, all components used for signalization at traffic intersections and roadways must be tested and approved by FDOT. No other component that is not listed on FDOT’s Approved Product List or another FDOT vendor proprietary traffic control system shall be used at traffic intersections or any other roadways.

 

On October 15, 2002 (Item No. 8), the Board approved an agreement between Broward County and FDOT which allows FDOT to reimburse the County for the cost of maintenance of traffic signals on State highways.

 

On June 15, 2010 (Item No. 10), the Board approved an agreement between Broward County and FDOT for the continued maintenance and operation of traffic signals or signal systems on the State highway systems. The agreement also included a change to the internal financial management number and to add compensation for maintenance of intersection control beacons. This agreement has no contract period, no renewal period, and no termination provisions. This agreement was meant to be in force on a perpetual basis.

 

On December 26, 2019, the Director of Purchasing approved a Sole Source/Sole Brand Request Memorandum for the InSync Traffic Control System from Rhythm Engineering, LLC (Exhibit 2).

 

The solicitation posted on February 13, 2019 and opened on February 19, 2019 (Exhibit 1). One response was received from Rhythm Engineering, LLC.

 

The Traffic Engineering Division has reviewed the bid submitted by Rhythm Engineering, LLC and concurs with the recommendation of award (Exhibit 3).

 

The prices offered by Rhythm Engineering, LLC compared favorably to the prices currently in FDOT’s Contract No. DOT-ITB-20-9034-GH and to FDOT’s project 15-1574 SW 8th Street project, which was implemented in 2016 by SICE, Inc. and to the extent the items were available for comparison. Not all items contained in the solicitation were available in FDOT’s contract (Exhibit 4).
