Previous Action Taken

On February 25, 2020, the Board of County Commissioners directed the Office of the County Attorney to draft an Ordinance amending the Capital Improvements Element (CIE) of the Broward County Comprehensive Plan, BrowardNEXT2.0, specifically amending Objective CI1 and related Policies CI1.11 and CI1.14 to reflect the Transportation Surtax projects and add the adopted 2020 schedule of capital improvements of the Board of County Commissioners and the Broward Metropolitan Planning Organization to meet statutory requirements (Item No. 31).

 

Summary Explanation/Background

THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT (EPGMD), THE LOCAL PLANNING AGENCY (LPA), AND THE PLANNING AND DEVELOPMENT MANAGEMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

Chapter 163, Part II, Florida Statutes requires the comprehensive plan to contain a Capital Improvements Element (CIE) which must include, among other things a schedule of capital improvements which includes any publicly funded projects of federal, state, or local government; projects necessary to ensure that adopted level-of-service standards are achieved and maintained for at least a five-year period; and, Transportation improvements included in the Broward Metropolitan Planning Organization’s transportation improvement program. This schedule must be adopted annually each year into the CIE after the new budget is adopted by the local government (included in Exhibit 1).

 

The proposed amendment revises CIE Objective CI1, Policy CI1.11, and Policy CI1.14 to incorporate funds generated by Broward County’s new transportation surtax into the CIE.  Also, references to specific tables are being deleted in order to avoid amending the Capital Improvements Element when a new type of capital funding table is added to Capital Improvement Schedule (shown in Exhibit 3, Attachment A).

 

On March 23, 2020, the EPGMD LPA recommended that the Board of County Commissioners (Board) find the proposed Amendment 20-T2 consistent with the Broward County Comprehensive Plan and transmit the amendment to the designated state review agencies.
