Why Action is Necessary

In accordance with the Broward County Procurement Code, Section 21.43 Board approval is required to extend the Agreement beyond five years.

 

What Action Accomplishes

Amends the existing agreement with Mission Critical Partners, Inc., which provides for consultant services for Broward County’s Public Safety Radio Communications Network, and for consultative and professional services that support improvements to first responder communications, and for bidirectional amplifier implementation and related testing services. The amendment extends the term of the agreement and increases applicable contract not-to-exceed amounts.

Summary Explanation/Background

THE OFFICE OF REGIONAL COMMUNICATIONS AND TECHNOLOGY RECOMMENDS APPROVAL OF THE ABOVE MOTION.

 

This item supports the Board’s vision of “Consistently delivering responsive, efficient, quality services to the public and internal customers” and the goal to “Build into every process and service effective checks and balanced that do not cause inefficiency, but rather ensure consistency, continuity, and quality.

 

On May 12, 2015 (item No. 22), the parties entered into an agreement between Broward County and Mission Critical Partners, Inc., for Consultant Services for Public Safety Radio Communications Network (RFP No. R1228606P1) for a total not-to-exceed amount of $3,792,921 for consulting services, reimbursables, pass-through items, frequency coordination services, and other optional services.

 

On January 9, 2018 (item No. 9), the Board authorized the Director of Purchasing to negotiate and execute a First Amendment to the Agreement.  The First Amendment was executed on August 1, 2018 and increased the not-to-exceed for Hourly Optional Services from $50,000 to $265,000 and the total contract not-to-exceed from $3,792,921 to $4,007,921. There is a scrivener’s error on the First Amendment, which incorrectly notes the total-not-to-exceed amount to be $4,057,921.

 

The Second Amendment (Exhibit 1) will extend the agreement for up to five one-year renewal terms and will increase the not-to-exceed amounts for Pass-Through Third Party Services from $300,000 to $700,000; increase the not-to-exceed amount for Optional Services utilizing a Work Authorization from $3,000,000 to $3,500,000; and increase the not-to-exceed amount for Hourly Optional Services from $265,000 to $350,000, for a total increase of the not-to-exceed amount of the contract by $985,000 from $4,007,921 to $4,992,921. In addition, the amendment removes the 10% Retainage requirement for “Phase IV - Implementation Related Services (Optional Services)” of Exhibit B, Table A, and replaces hourly rates listed in Exhibit B, Table B.
