MOTION TO AUTHORIZE County Administrator to negotiate and execute a second amendment to Agreement titled “Bus Shelter Maintenance, Graffiti Removal and Traffic Engineering Field Checks” (“Contract 2”) between Broward County and OIC of South Florida, Inc., subject to review for legal sufficiency by the Office of the County Attorney, extending the term of the contract through March 31, 2022, increasing the maximum contract amount by $918,758, from the current amount of $618,293 to $1,537,051, which increased amount includes $95,034 to provide for an increase in wages to align with the County’s living wage amount without benefits, and $411,528 to include additional Broward County Transit bus stops in the scope of services; and authorize the County Administrator to take all administrative and budgetary actions necessary to implement the Agreement, as amended.

Previous Action Taken

The Board approved the Employment Self-Sufficiency Program (“ESS Program”) and authorized the County Administrator and Director of Purchasing to enter into contracts with nonprofit organizations related to the ESS Program on June 14, 2016, agenda item 54.

 

Summary Explanation/Background

The ESS Program was created to provide employment opportunities to Broward County residents in distressed communities and to “clean-up” unsightly areas within unincorporated areas of Broward County. The ESS Program includes services such as maintenance of vacant properties, graffiti removal, and maintenance of bus shelters. The ESS program also provides training and employment opportunities to Broward County residents that: (i) are age 18 or older, (ii) reside in Broward Municipal Services District (“BMSD”) boundaries and other economically distressed communities, and (iii) are unemployed or have low income. The County solicited proposals from nonprofit organizations to provide specialized job readiness classes, a path to GED attainment, vocational and job skills training, job placement, and budgeting and personal finance classes. Through a competitive process, the County contracted with a nonprofit organization, OIC of South Florida, Inc. (“OIC”), formerly known as OIC of Broward County, Inc., to provide these services to residents living within the BMSD and other economically distressed communities consistent with authorization from the June 14, 2016 Commission Meeting, agenda item 54. The goal of the ESS Program is to provide a pathway to employment for residents of the BMSD and other economically distressed communities, many of which face employment barriers due to past criminal convictions, lack of employability skills, and low educational attainment.

 

Motion A and B allows the County Administrator to negotiate and execute second amendments to the agreements with OIC, subject to review for legal sufficiency by the Office of the County Attorney. The amendment to Contract 1 will include the maintenance of additional County-owned properties located within the BMSD and provide for living wage rates. The amendment to Contract 2 will extend the term of the agreement to continue through March 31, 2022, increase the number of bus stop locations maintained from 32 to 108 locations, and provide for living wage rates.

 

Currently, the agreements do not provide for living wage rates. The amendments to the agreements will allow OIC employees to be paid Broward County living wage rates without benefits for the remaining term of the Agreements, as specified in the Living Wage Ordinance, effective April 1, 2020. For services provided by OIC, employees are currently paid an hourly rate of $11 per hour without benefits. The current living wage rate without benefits is $15.12 per hour.

Fiscal Impact

Fiscal Impact/Cost Summary

The extension of the term for Contract 2 ($412,195), expansion of the bus stop locations ($411,528) and maintenance of County-owned properties ($109,676) are already included in the budget.

 

Adjusting the living wage rate amount is estimated to cost $193,578. Additional funding will need to be allocated for living wage.
