Why Action is Necessary

Motion A. In accordance with the Broward County Procurement Code, Section 21.34, Sole Source Procurement, Board approval is required for awards exceeding the Director of Purchasing's authority.

 

Motion B. In accordance with the Broward County Procurement Code, Section 21.31.a.4, Award Authority, Board approval is required for awards exceeding $500,000 that includes a single bidder, rejection of apparent low bidder, or protested award.

Summary Explanation/Background

THE PURCHASING DIVISION AND THE PUBLIC WORKS DEPARTMENT/WATER AND WASTEWATER SERVICES RECOMMEND APPROVAL OF THE ABOVE MOTIONS.

 

The purpose of the resultant contract is to provide replacement Varec Flame Arrester repair parts and assemblies for Water and Wastewater Services (WWS). The Varec Flame Arrester is a complex system critical to WWS operations and is responsible for safely transporting and burning biogas vapors that are emitted.

 

In addition, the core function of the flame arrester system is to relieve excessive gas pressure and vacuum, generated in the gas line, protecting it from an accidental ignition/explosion that could be catastrophic to public health and safety.

 

The manufacturer, Varec Biogas Inc., indicated that the current manufacturer exclusive municipal distributor is TSC-Jacobs, Inc. Based on this information, the Director of Purchasing recommends approval of this sole source, sole brand designation (Exhibit 1).

 

WWS has reviewed the bid submitted by TSC-Jacobs, Inc., and concurs with the recommendation for award (Exhibit 3). No vendor performance evaluations have been completed for TSC-Jacobs, Inc.

 

The initial bid submitted by TSC-Jacobs, Inc. was $316,758, inclusive of a pass-thru allowance in the amount of $54,000. The vendor offered a voluntary price reduction (VPR) from $316,758 to $235,694, resulting in a savings of $81,064 and a revised total contract value of $235,694. The Broward County Procurement Code, Section 21.30.f2(c), allows for a voluntary price reduction, if the reduction does not result in the modification or deletion of any condition of the bid.

 

The Purchasing Division has analyzed the prices submitted by the bidder, TSC-Jacobs, Inc., and has determined that the prices submitted are fair and reasonable. The unit prices and total contract value (VPR) were analyzed against the unit prices of the prior contract, the estimated contract value, the impact of regulatory tariffs, and the change in the Producer Price Index (PPI) for the specified products (aluminum). The previous contract prices were established in 2016. The estimated contract value was based on the previous contract prices. From the period of establishment of the previous contract, factors associated with price increases for the commodities associated with this contract include regulatory tariffs and producer price increases (Exhibit 4).

 

There were no protests or appeals filed regarding this procurement.

 

The amounts referenced in this agenda have been rounded to the nearest whole dollar. Vendor payments will be based on the actual total bid amount.

 

The bid tabulation reflects the actual amount of the award (Exhibit 2).

 

The bid posted on August 27, 2019 and opened on September 13, 2019.

 

The bid validity for this project expired on January 13, 2020. TSC-Jacobs, Inc. agreed to extend its bid validity through May 31, 2020 for this project.
