MOTION TO ADOPT Resolution No. 2020-278 directing the County Administrator to publish Notice of Public Hearing to be held on Tuesday, June 2, 2020, at 10:00 a.m., in Room 422 of the Governmental Center to consider enactment of a proposed Ordinance, the title of which is as follows:
AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO THE BROWARD COUNTY CONSTRUCTION APPRENTICESHIP PROGRAM, SECTIONS 26-9 THROUGH 26-11 OF THE BROWARD COUNTY CODE OF ORDINANCES ("CODE"); AMENDING THE DEFINITION OF CONSTRUCTION PROJECT; PROVIDING REPORTING REQUIREMENTS FOR CONTRACTORS AND SUBCONTRACTORS; AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE.

Summary Explanation/Background
On August 19, 2019, the Board directed the Office of the County Attorney to draft certain changes to code provisions addressing the Construction Apprenticeship Program ("Apprenticeship Program") and waived the requirements of the Apprenticeship Program until the amendments were enacted by the Board.
The proposed amendments change the definition of a covered construction project to increase the threshold dollar amount from $2,000,000 to $5,000,000, and limit the Ordinance's application to projects priced on the basis of a lump sum/fixed price amount. The proposed amendments also provide that change orders are included in the requirement that twelve percent (12%) of labor hours on the construction project must be performed by apprentices employed by the contractor or subcontractors.
The proposed amendments further require that a contractor certify, on a monthly basis, accurate and timely records identifying the following information: the name, hourly rate, and trade classification of each apprentice; the cumulative number of hours worked on the project to date by apprentices; and the labor hours of all workers used by the contractor and each subcontractor on the construction project. The requirement to provide the address of the apprentice was eliminated.
The Ordinance also has a deferred effective date, which would make the program effective sixty (60) days after the expiration of the Local State of Emergency declared on March 10, 2020.
