Why Action is Necessary
In accordance with the Broward County Procurement Code, Section 21.135.e, the Director of Purchasing shall have the authority to enter into a contract awarded by a public procurement unit if the public procurement unit and/or the vendor agree to such an award of their contract and the procurement was accomplished under generally accepted public procurement principles. The actual award of such a contract shall be made by the applicable awarding authority.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE TRANSPORTATION DEPARTMENT/TRANSIT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.
This item supports the Board’s Value for “Cooperatively delivering an efficient and accessible regional inter-modal transportation network.”
The Office of Economic and Small Business Development (OESBD) did not assign Certified Business Enterprise goals for this procurement because it involves a purchase through a pre-existing contract, which does not fall under the review authority of OESBD (Exhibit 1).
The purpose of this contract is to provide for an extensive variety and quantity of commuter buses, transit buses, electric buses, and medium duty transit vehicle (Cutaway). Obtaining the necessary vehicles will improve the capacity of the transit system. Broward County Transit (BCT) Division is seeking to piggyback on the State of Georgia Contract No. 99999-001-SPD-0000138-0006 for the purchase of five over-the-road coaches, at a unit cost of $611,200 per vehicle, plus additional costs for spare parts, engine and transmission diagnostic equipment, and training (Exhibit 2) at a total estimated cost of $3,262,670.
The State of Georgia Request for Proposal (RFP) No. 99999-001-SPD-0000152 was competitively solicited by the State of Georgia, through the Department of Administrative Services, State Purchasing Division on December 14, 2017 and closed on February 6, 2018 (Exhibit 3). RFP No. 99999-001-SPD-0000152 resulted in the award of eight contracts, in which Contract No. 99999-001-SPD-0000138-0006 was awarded to Motor Coach Industries, Inc., and is currently in effect from July 1, 2018 through June 30, 2020 (Exhibits 4 and 5).
The State of Georgia contract complies with the Federal Transit Administration (FTA) piggyback requirements and includes options that meet BCT’s technical specification requirements, allows for prompt replacements of older model buses which have reached their useful lifecycles, aids in achieving a state of good repair, and avoids reliability and increasing maintenance costs associated with older buses.
Given the long lead times for bus production, BCT needs to facilitate the acquisition of these five over-the-road coaches to meet the service demands for system expansion and the regular replacement of older buses. This piggyback contract provides BCT with the mechanism to accelerate the delivery of these commuter buses to achieve their important operational priorities in a timely manner.
The Purchasing Agent and the Transit Division have determined that the utilization of Contract No. 99999-001-SPD-0000138-0006 will allow for the County to benefit from economical pricing and reduction in delivery time. Utilization of this contract will also allow the County the ability to take advantage of lower costs available through competitive pricing, while reducing administrative costs of project solicitation.
The State of Georgia has authorized BCT to utilize the contract to secure the necessary vehicles for Broward County (Exhibit 6). Obtaining the necessary vehicles will improve the capacity of the transit system. In order to expedite the procurement of the transit buses and obtain delivery in an efficient manner, whereby timeliness is a major factor, the Transit Division is requesting approval to again utilize and piggyback this contract.
