MOTION TO ADOPT Resolution No. 2020-336 to place a proposed amendment to the Broward County Charter on the ballot for the November 3, 2020, General Election, amending Section 11.01 of the Broward County Charter to establish that County ordinances with respect to regional facilities intended to serve a public purpose prevail over contrary Municipal ordinances, the title of which is as follows:
A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PROVIDING FOR A REFERENDUM ELECTION TO BE HELD ON NOVEMBER 3, 2020, THE DATE OF THE GENERAL ELECTION, TO DETERMINE WHETHER TO AMEND THE BROWARD COUNTY CHARTER TO PROVIDE THAT, WITH REGARD TO DEVELOPMENT OF COUNTY PROPERTY FOR REGIONAL FACILITIES INTENDED TO SERVE A PUBLIC PURPOSE, COUNTY ORDINANCES SHALL PREVAIL OVER MUNICIPAL ORDINANCES TO ENSURE THAT NECESSARY REGIONAL FACILITIES, INCLUDING THOSE NECESSARY TO IMPLEMENT THE SURTAX FUNDED PLAN TO DRAMATICALLY IMPROVE TRANSPORTATION OPTIONS, CAN BE DEVELOPED IN A MANNER TO BENEFIT RESIDENTS COUNTYWIDE; AND PROVIDING FOR SEVERABILITY AND AN EFFECTIVE DATE.

Summary Explanation/Background
The proposed Resolution sets forth an amendment to the Broward County Charter that, if approved by the Broward County electorate during the 2020 General Election, would establish that Broward County ordinances with respect to the development, on County property, of regional facilities intended to serve a public purpose would prevail over any conflicting Municipal ordinances. Six (6) affirmative votes are required to pass this Resolution.
