Why Action is Necessary
In accordance with the Broward County Procurement Code, Section 21.94.a, Board approval is required for amendments to contracts exceeding the award authority of the Director of Purchasing.
What Action Accomplishes
Allows for the Consultant to continue providing engineering services while project is under construction, by extending the agreement time for performance and adjustments to salary costs.

Summary Explanation/Background
THE PUBLIC WORKS DEPARTMENT/WATER AND WASTEWATER SERVICES RECOMMENDS APPROVAL OF THE ABOVE MOTION.
The Office of Economic and Small Business Development established a County Business Enterprise (CBE) cumulative participation goal for this agreement of 22%. As of April 2020, Hazen and Sawyer has been paid $2,119,478 with $584,716 paid to CBE firms, yielding 27.6% CBE participation to date (Exhibit 1).
On February 10, 2015 (Item No. 26), the Board of County Commissioners approved the Agreement RFP No. R1061305P1 (Exhibit 2) between Broward County and Hazen and Sawyer, P.C. for Consultant Engineering Services for North Regional Wastewater Treatment Plant - Fine Bubble Aeration Basin Conversion in Broward County, Florida, for services associated with the overall, planning, design, procurement, and construction observation of the project, for maximum amount not-to-exceed of $3,696,976 and a time for performance of 2,035 consecutive days.
The proposed First Amendment to the Agreement (Exhibit 3) extends the time for performance by 730 days for total of 2,765 consecutive days and includes a contract provision for annual Consumer Price Index (CPI) rate adjustments for Consultant compensation.
