Summary Explanation/Background

THE PORT EVERGLADES DEPARTMENT RECOMMENDS APPROVAL.

 

The Broward Sheriff’s Office (“BSO”) has been providing seaport security and law enforcement services at Port Everglades under a series of agreements since the 1990’s.

On September 10, 2015 (Item No. 32), the Broward County Board of County Commissioners (“Board”) approved the most recent Interlocal Agreement between Broward County and the Sheriff of Broward County to provide Seaport Security and Law Enforcement Services at Port Everglades for a five-year term effective October 1, 2015, and ending on September 30, 2020.

 

Staff initiated discussions with BSO in early 2020 concerning a new Interlocal Agreement to reflect current practices and services provided by BSO at Port Everglades. However, the impacts of COVID-19 on business activity at Port Everglades, including the suspension of multi-day cruises since March 2020, along with reductions in cargo and petroleum throughput resulting from COVID-19 impacts throughout the world, have resulted in significant reductions in Port revenue in Fiscal Year 2020, with large reductions also being forecasted for Fiscal Year 2021. Because of the significant reductions in business activity in Fiscal Year 2020 and projected for Fiscal Year 2021, Port Everglades staff began discussions with BSO in May 2020 concerning changes to the level of BSO services provided to the Port to better reflect business activity at the Port, with a corresponding reduction in expenses. 

 

Since some of the service changes still under discussion would affect the scope of services in the Interlocal Agreement, staff recommends a three-month extension to the existing Interlocal Agreement with no other changes. Funding for seaport security and law enforcement services by BSO for the three-month period would be based on the final Fiscal Year 2021 Operating Budget for Port Everglades approved by the Board.

 

The First Amendment to Agreement has been reviewed and approved as to form by the Office of the County Attorney.
