Summary Explanation/Background
THE PARKS AND RECREATION DIVISION RECOMMENDS APPROVAL OF THE ABOVE MOTIONS.
Broward County (“County”) has been receiving matching grant funds from the Children’s Services Council of Broward County (“CSC”) since 2002 for the County’s SWIM Central Program, operated by the Broward County Parks and Recreation Division, for water-safety education and instruction for County children on a reimbursement basis with contracting agencies. In Fiscal Year 2020, the County received total funding in the amount of $687,782 from the CSC, requiring a $516,466 County cash match. The CSC accepted its staff’s recommendations of May 21 and August 21, 2020, to appropriate $687,782 for the County’s SWIM Central Program for the period of October 1, 2020, through September 30, 2021.
The services to be provided by the County’s SWIM Central Program, through Broward County Parks and Recreation Division, are specified in Exhibit A - Scope of Work of the Agreement. It is estimated that this funding, along with the County match of $ 543,646 for Fiscal Year 2021, and the School Board of Broward County’s contribution of $200,000 will provide water-safety education and instruction to approximately 24,700 children residing in Broward County.
The Agreement is on a form prepared by the CSC and incorporates only some recommended changes requested by the County. The CSC is providing funding to the County and has requested the County execute the Agreement first. The CSC form agreement includes certain non-standard provisions, including the County’s obligation to indemnify the CSC for intellectual property infringement claims and a cross-indemnification provision relating to claims for violation of privacy rights (including claims brought for alleged violations of the Family Educational Rights and Privacy Act).
