Why Action is Necessary

Motions A and B: The County Administrator must provide notice to the Broward County Board of County Commissioners (“Board”) of all grant agreements signed during a scheduled Board recess or period of time when the Board does not formally meet, and non-action of Broward County (“County”) will jeopardize receipt of the grant.

 

What Action Accomplishes

Motions A and B: Provides notice of the Federal Aviation Administration (“FAA”) grant agreements executed by the County Administrator during a time where emergency approval was required to meet the national grant execution deadline set forth by the FAA and in accordance with Section 20.31.b.3., Broward County Administrative Code.

Summary Explanation/Background

THE AVIATION DEPARTMENT RECOMMENDS APPROVAL OF THE ABOVE MOTIONS.

 

Section 20.31.b.3, Broward County Administrative Code, authorizes the County Administrator to execute any and all grants agreements on behalf of the Board during any scheduled Board recess and during any period of time when the Board does not formally meet and non-action by the County would jeopardize receipt of a grant. The FAA awarded Broward County Aviation Department (“BCAD”) two grants on September 4, 2020 and September 8, 2020 with an execution deadline of September 15, 2020. In order to accept and fully execute the grants, BCAD needed to adhere to the FAA’s national grant execution deadline of September 15, 2020. The FAA deadline did not allow enough time to include the grant agreements on the Agenda for the September 10, 2020, or September 22, 2020, Board meetings. Per the recommendation of the Broward County Grants Administration office, the County Administrator executed the two grant agreements on September 11, 2020, for submission to the FAA.

 

Due to the Coronavirus Aid, Relief, and Economic Security (“CARES”) Act created in 2020, all Airport Improvement Program (“AIP”) grants awarded by the FAA are issued at 100% award. The County does not need to provide a local match.

 

MOTION A

The FAA awarded BCAD with Grant Agreement 03-12-0029-011-2020 for Broward County’s North Perry Airport (“HWO”) Runway Safety Enhancements Project (“Project”). The Project addresses potential safety issues on the southwest corner of the airport where the approach ends of Runways 10R and 1L converge. The Project will reduce 350 feet of pavement on Runway 1L and add 207 feet of Pavement to Runway 10R and the south parallel Taxiway “L”. The safety enhancement is solely undertaken to reduce the potential for a runway incursion, including wrong runway departures. There will be no change to the operational conditions, type of aircraft that utilize the airport, or capacity at HWO. The safety enhancement will benefit the communities to the east and southeast of the airport as departing aircraft on Runway 10R will be at a higher altitude, over those areas. The action will allow for the tie in of a future Taxiway “A” as identified in the latest draft Airport Master Plan which, if constructed, will serve Runway 1L-19R. The total amount of the grant awarded is $1,614,518 using FAA discretionary funds.

 

MOTION B

The FAA awarded BCAD Grant Agreement 03-12-0025-091-2020 for Broward County’s Fort Lauderdale-Hollywood International Airport (“FLL”) North Runway Rehabilitation Project. The grant allows BCAD to recover costs tied to the Runway 10L-28L Lighting system project, which includes installation of Medium Intensity Approach Lighting System and installation of the Runway Status Lights at FLL. This grant also includes construction work associated with Taxiway A Pavement from Runway 10L-28R to Connector Taxiway A1. The total amount of the grant awarded is $7,280,576 using FAA discretionary funds.

 

The Grant Agreements have been reviewed by the Office of the County Attorney and approved as to form. However, these agreements do not include the County's standard agreement provisions because the FAA requires the use of its form agreements.
