Why Action is Necessary

In accordance with the Broward County Procurement Code, Section 21.94.a, Board approval is required for amendments to contracts exceeding the award authority of the Director of Purchasing.

 

What Action Accomplishes

Allows the Consultant to continue providing construction-phase engineering services by extending the agreement time for performance, providing for preparation of regulatory permits, and by adding provisions to adjust consultant compensation.

Summary Explanation/Background

THE PUBLIC WORKS DEPARTMENT/WATER AND WASTEWATER SERVICES RECOMMENDS APPROVAL OF THE ABOVE MOTION.

 

The Office of Economic and Small Business Development established County Business Enterprise (CBE) participation goal for this agreement of 25%. As of June 19, 2020, Hazen and Sawyer has been paid $5,956,242 with $1,598,856 paid to CBE firms, yielding a 26.8% of CBE participation to date. (Exhibit 1).

 

On August 13, 2013 (Item No. 53), the Board of County Commissioners approved Agreement, RLI No. R0999201R1 (Exhibit 2) between Broward County and Hazen and Sawyer, P.C. for Consultant Engineering Services for the North Regional Wastewater Treatment Plant - Capacity Improvements in Broward County, Florida, with the maximum not-to-exceed amount of $5,296,230, with a time for performance of 1,800 consecutive calendar days from the Notice to Proceed.

 

On February 2, 2016 (Item No. 5), the Board of County Commissioners approved the First Amendment to Agreement, RLI No. R0999201R1 (Exhibit 3) for services associated with the overall management, planning, design, procurement, and construction observation of the project, for a total revised amount of $5,973,300.

 

The proposed Second Amendment to Agreement, RLI No. R0999201R1 (Exhibit 4) will provide permitting assistance for regulatory agency operating permit renewal, additional engineering services for the injection wells, and assistance, if needed, for mediation, arbitration and litigation support for District 4 wastewater treatment and disposal facilities with an increase in the not-to-exceed contract amount of $257,588 for a revised total contract amount of $6,230,888, with an increase in time for performance of 1,000 days for a total of 2,800 consecutive calendar days.

 

Agreement was negotiated in a sunshine meeting held on January 29, 2020 and the proposed Amendment has been reviewed and approved as to form by the Office of the County Attorney and the Risk Management Division.
