MOTION TO AWARD open-end contract to low responsive, responsible bidder, Swarco Industries, Inc., for Thermoplastic Pavement Marking Material and Glass Beads, Bid No. OPN2120996B1, for the Traffic Engineering Division, in the initial one-year estimated amount of $599,850, and authorize the Director of Purchasing to renew the contract for two one-year periods, for a potential three-year estimated amount of $1,799,550. The initial contract period shall begin on the date of award and will terminate one year from that date.

In accordance with the Broward County Procurement Code, Section 21.31.a.4, Award Authority, Board approval is required for awards exceeding $500,000 that includes a single bidder, rejection of apparent low bidder, or protested award.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE PUBLIC WORKS DEPARTMENT/TRAFFIC ENGINEERING DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.
The Office of Economic and Small Business Development did not assign County Business Enterprise (CBE) goals to this procurement because there are no CBE firms available to supply these products (Exhibit 2).
In accordance with the Broward County Workforce Investment Program, Broward County Administrative Code, Section 19.211, these services are subject to the Workforce Investment Program. Swarco Industries, Inc. has agreed to be bound to the contractual obligations of the Workforce Investment Program.
The purpose of the contract is to supply thermoplastic pavement striping material and glass beads to be used for maintenance on County roadways. The County must maintain markings on the roadways as part of the pavement striping maintenance program and to comply with the Florida Department of Transportation standards.
The Director of Purchasing has determined that the apparent low bidder, Potters Industries, LLC is non-responsive for failure to bid on all items of the Group, they submitted a bid only for Item 3.
The Traffic Engineering Division has reviewed the bid submitted by Swarco Industries, Inc., and concurs with the recommendation for award (Exhibit 3). Four vendor performance evaluations have been completed for Swarco Industries, Inc.; they have an overall rating of 4.52 out of a possible rating of 5.0. Copies of the vendor performance evaluations are available upon request.
Incumbents: Ennis-Flint Inc. and Potters Industries, LLC, Contract No. J2114514B1, Thermoplastic Pavement Marking; Contract Term: October 10, 2017 through October 09, 2020; Expenditures to Date: $761,384 and $8,850, respectively.
The Purchasing Division has researched the prices submitted by the recommended bidder, Swarco Industries, Inc., and has determined that the prices submitted are fair and reasonable in comparison to the current Broward County contract, the Consumer Price Index, and the bids of other respondents (Exhibit 4).
There was no protest or appeal filed regarding this procurement.
The bid posted on May 22, 2020 and opened on June 17, 2020; five bids were received with no declinations (Exhibit 1).
