Why Action is Necessary

A. Board of County Commissioners’ approval is required for the Off-System Construction and Maintenance Agreement.

What Action Accomplishes

A. Formalizes the responsibilities of the County and the Florida Department of Transportation regarding installation of landscaping and irrigation within the median and east swale of Palm Avenue from approximately 50 feet north of the Homestead Turnpike Extension right-of-way to south of Premier Parkway.

 

B. Formalizes the responsibilities of the County and the City of Miramar regarding maintenance of landscaping and irrigation within the median and east swale of Palm Avenue from approximately 50 feet north of the Homestead Turnpike Extension right-of- way to south of Premier Parkway; specifically, assigning all of Broward County’s responsibilities under the Off-System Construction and Maintenance Agreement to the City of Miramar.

Summary Explanation/Background

PUBLIC WORKS DEPARTMENT/HIGHWAY CONSTRUCTION AND ENGINEERING DIVISION RECOMMENDS APPROVAL OF THE ABOVE MOTION.

 

On December 13, 2016 (Item No. 35), the Board of County Commissioners approved the Off-System Construction and Maintenance Agreement between Broward County and the Florida Department of Transportation for improvements to SR 847/Palm Avenue from County Line Road to Premier Parkway, a County road in the City of Miramar. The improvements include widening the road from two to four lanes with a median, drainage improvements, ADA accessibility, crosswalks, bike lanes, lighting improvements, signage, pavement markings, and traffic control devices.

 

Motion A will allow the Florida Department of Transportation to install landscaping and irrigation in the County right-of-way within the median and east swale of Palm Avenue from approximately 50 feet north of the Homestead Turnpike Extension right-of-way to south of Premier Parkway. The landscaping improvements shall incorporate a minimum 50% native species by plant types and shall follow the Broward County NatureScape program and Florida-Friendly Landscaping principles.

 

Motion B will obligate the City of Miramar to maintain the improvements installed by the Florida Department of Transportation within County right-of-way. The agreement allows the County to terminate the agreement with or without cause at any time. If the agreement is terminated, the City of Miramar must remove all improvements within the licensed right-of-way and restore the area to its original condition.

 

The agreement has been reviewed and approved as to form by the County Attorney’s Office.
