Why Action is Necessary

Board approval is required to vacate plats, easements and rights-of-way pursuant to Chapter 5, Article IX of the Broward County Code of Ordinances.

Directs the County Administrator to publish a Notice of Public Hearing for the abandonment of easements in accordance with Chapter 5, Article IX of the Broward County Code of Ordinances.

Summary Explanation/Background

THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT AND THE PLANNING AND DEVELOPMENT MANAGEMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

The Planning and Development Management Division has received a request to vacate a 70-foot private access easement lying within Parcel A of Port Everglades Plat No. 12, as recorded in Plat Book 153, Page 31 of the Public Records of Broward County and is located at 3500 Southeast 18 Avenue in the City of Hollywood.

 

Because this easement was granted to Broward County through separate instrument, Board approval is required to vacate any interests or rights to the easement. Vacating this easement will provide clear and unencumbered title to the property owner.

 

The City of Hollywood adopted Resolution No. R-2019-341 on November 20, 2019 granting approval of the abandonment and vacation of the 70-foot private access easement. Review of this application by the applicable reviewing agencies indicates that there is no objection to the abandonment and vacation of the subject easement.

 

This vacation application has been reviewed and approved as to form by the Office of the County Attorney (Exhibit 1).

 

In the event Executive Order 20-69 is not extended by the Governor, staff will revise the public notice accordingly before placing an advertisement for the December 1, 2020  hearing. See Exhibit 3 for the Public Notice.
