In accordance with Broward County Procurement Code, Section 21.31.a.4, Award Authority, Board approval is required for awards exceeding $500,000 that includes a single bidder, rejection of apparent low bidder, or protested award.

Summary Explanation/Background

THE PURCHASING DIVISION AND THE PUBLIC WORKS DEPARTMENT/FACILITIES MANAGEMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

The Office of Economic and Small Business Development (OESBD) designated this a reserved project for County Business Enterprise (CBE) firms. The OESBD has determined that FG Construction, LLC meets the eligibility criteria of the CBE reserve program (Exhibit 2).

 

The purpose of the contract is to furnish all labor, equipment, and materials necessary to provide parking lot sealing and striping services for the Facilities Management Division and other Broward County agencies.

 

The allowances in this contract in the total annual amount of $25,000 includes: $5,000 for parts and materials, $10,000 for non-Broward County permits and fees, and $10,000 for specialized construction activities. These allowance items must be approved by the contract administrator prior to purchase and will be reimbursed at the contractor’s actual incurred cost, without markup.

 

This contract includes covered services, in accordance with Broward County Living Wage Ordinance, Section 26-101(k). FG Construction, LLC has agreed to be bound to the contractual obligations.  The three-year potential estimated amount includes the health care benefit increase effective January 1, 2021. 

 

This procurement was reserved for CBE firms, upon review of the bids, OESBD determined that the apparent low bidder, M & M Asphalt Maintenance, Inc. d/b/a All County Paving, did not meet the CBE program requirement; thus, the vendor was non-compliant to the solicitation’s CBE program requirement.  Therefore, the Director of Purchasing deemed the apparent low bidder, M & M Asphalt Maintenance, Inc. d/b/a All County Paving, to be non-responsive to the solicitation’s CBE program requirement (Exhibit 2).  The difference between the apparent low bidder and the recommended bidders bid amount is $12,879. 

 

The Facilities Management Division has reviewed the bid submitted by FG Construction, LLC and concurs with the recommendation for award (Exhibit 3). Four vendor performance evaluations have been completed for FG Construction, LLC; they have an overall rating of 3.93 out of a possible 5.0. Copies of the vendor performance evaluations are available upon request.

 

The Purchasing Division has researched the prices submitted by the low responsive, responsible bidder, FG Construction, LLC, and has determined that the prices submitted are fair and reasonable in comparison to the current Broward County contract, the Consumer Price Index, and other bids (Exhibit 4).

 

The amounts referenced in this agenda item were rounded to the nearest whole dollar. Vendor payments will be based on the actual total bid amount. The bid tabulation reflects the actual amount of the award.

 

There was no protest or appeal filed regarding this procurement.

 

Incumbent: FLG Services, Inc., Contract Number and Title: Contract No. W2112511B1, Parking Lot Sealing and Striping Services, Contract Term: February 7, 2017 through May 6, 2020. Expenditures to date: $1,266,108.68. Interim Contract No. W2112511X1, Parking Lot Sealing and Striping Services, Contract Term: May 6, 2020 through November 6, 2020. Expenditures to date: $7,550.

 

The bid posted on July 14, 2020 and opened on August 5, 2020; five bids were received with no declinations (Exhibit 1).
