Board approval is required to vacate plats, easements and rights-of-way pursuant to Chapter 5, Article IX of the Broward County Code of Ordinances.

Summary Explanation/Background
THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT AND THE PLANNING AND DEVELOPMENT MANAGEMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.
The Planning and Development Management Division has received a request to vacate a 15-foot drainage easement lying within lots 3 and 4, block 7 of Little Harbor on the Hillsboro Section 4 Plat, as recorded in Plat Book 49, Page 25 of the Public Records of Broward County, and is located at 64 Northeast 11 Way in the City of Deerfield Beach. Vacating the drainage easement will provide clear and unencumbered title to the property owner.
The City of Deerfield Beach adopted Resolution No. 2020/002 on January 14, 2020 granting approval of the abandonment and vacation of the drainage easement. Review of this application by the applicable reviewing agencies indicates that there are no objections to the abandonment and vacation of the subject easement.
This vacation application has been reviewed and approved as to form by the Office of the County Attorney, see Exhibit 1.
In the event Executive Order 20-69 is not extended by the Governor, staff will revise public notice accordingly before placing an advertisement for the December 8, 2020 hearing. See Exhibit 3 for the Public Notice.
