Summary Explanation/Background
PUBLIC WORKS DEPARTMENT/HIGHWAY CONSTRUCTION AND ENGINEERING DIVISION RECOMMENDS APPROVAL OF THE ABOVE MOTION.
SW 27th Avenue (Riverland Road) is a County road located in the City of Fort Lauderdale. HBH CSU Support Corporation and the City of Fort Lauderdale desire to improve a portion of the County right-of-way along the east side of SW 27th Avenue (Riverland Road) south of SW 2nd Court.
This item seeks Board approval of a Revocable License Agreement (the “Agreement”) between Broward County, HBH CSU Support Corporation, and the City of Fort Lauderdale for the installation and maintenance of improvements along the east side of SW 27 Avenue (Riverland Road) south of SW 2nd Court. (Exhibit1). Exhibit 2 is a location map of the Revocable License Area.
The proposed improvements include landscaping and irrigation at no cost to the County. The landscaping improvements shall incorporate a minimum 50% native species by plant types and shall follow the Broward County NatureScape program and Florida-Friendly Landscaping principles. The Agreement will allow HBH CSU Support Corporation and the City of Fort Lauderdale to install the improvements within County right-of-way. HBH CSU Support Corporation will be obligated to maintain these improvements. In the event that HBH CSU Support Corporation fails to maintain the improvements, the City of Fort Lauderdale is obligated to perform the maintenance. The Agreement also allows the County to terminate the Agreement with or without cause at any time. If the Agreement is terminated, HBH CSU Support Corporation must remove all improvements within the licensed right-of-way and restore the area to its original condition or to such condition as approved in writing by the County Administrator.
The Agreement has been reviewed and approved as to form by the Office of the County Attorney and the Risk Management Division.
