MOTION TO APPROVE Agreement between Broward County and Chen Moore and Associates, Inc., for Request for Proposals (RFP) No. PNC2119212P1, Consulting Services for Port Everglades, for an initial three-year contract term not to exceed $3,000,000, and authorize the Director of Purchasing to renew the Agreement for up to two one-year terms, for a total five-year contract term not-to-exceed $5,000,000, and authorize the Mayor and Clerk to execute the same. The initial term of this agreement will be effective upon date of execution and will terminate three years from that date.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE PORT EVERGLADES DEPARTMENT RECOMMEND APPROVAL OF THE ABOVE MOTION.
The Office of Economic and Small Business Development established a County Business Enterprise (CBE) participation goal of 25% for this project. Chen Moore and Associates, Inc. has committed to meet the CBE participation goal (Exhibit 3).
The purpose of this Agreement is to engage the services of a qualified firm to provide professional architectural, engineering, and related services for remodeling, renovation, and new construction projects in which construction costs do not exceed $2,000,000 (Exhibit 2).
On June 11, 2019 (Item No. 74A), the Board authorized the County Administrator to approve Request for Proposals for advertisement during the 2019 summer recess.
On August 7, 2019, the County Administrator approved Request for Proposal (RFP) No. PNC2119212P1, Consulting Services for Port Everglades. The RFP was advertised and at the time of the opening deadline on September 9, 2019, eight firms submitted proposals.
On November 26, 2019, an Initial Evaluation Committee Meeting was held. The Evaluation Committee determined all eight firms were both responsive and responsible to the RFP requirements and voted in favor of all advancing to be numerically scored and ranked by the Evaluation Committee.
On December 9, 2019, a Final Evaluation Committee Meeting was held. After presentations, evaluation, scoring, and ranking, the Evaluation Committee named Chen Moore and Associates, Inc. as the first-ranked firm.
On December 26, 2019, the Director of Purchasing received an objection letter from Shutts & Bowen, LLP on behalf of Bermello Ajamil & Partners, Inc. (Bermello), the second-ranked firm.
On April 1, 2020, the Director of Purchasing issued a response to Shutts & Bowen LLP stating that Chen Moore and Associates, Inc. responded to the RFP as required and that the issues raised in the objection were not of sufficient merit to recall or otherwise alter the recommendation of the Evaluation Committee. No new substantive information was presented by Bermello to warrant the reconvening of the Evaluation Committee. The evaluation and scoring of firms were conducted appropriately and within the established guidelines, practices, and procedures set forth in the Broward County Procurement Code, Ordinances, and existing written guidelines.
The Evaluation Committee’s final recommendation of ranking was posted on the Purchasing Division website from April 2 - 10, 2020, which provided an opportunity for any aggrieved proposer to file a formal protest. No formal protest was received.
On May 19, 2020 (Item No. 53), the Board approved final rankings of the qualified firms for Request for Proposals (RFP) No. PNC2119212P1.
One negotiation meeting was held on June 18, 2020. The meeting was attended by representatives from Chen Moore and Associates, Inc., the Office of the County Attorney, the Purchasing Division, and the Port Everglades Department.
