Why Action is Necessary

In accordance with the Broward County Procurement Code, Section 21.43, Specific Period, a contract for supplies or services may be entered into for no more than five years without the express consent of the Board. Therefore, Board of County Commissioners’ approval is required for this amendment in accordance with the provisions of the Broward County Procurement Code.

Allows for continued security guard services to be provided at various Broward County facilities while the new solicitation is in process.

Summary Explanation/Background

THE PUBLIC WORKS DEPARTMENT/FACILITIES MANAGEMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

On November 10, 2015 (Item No. 41), the Board of County Commissioners awarded open-end Contract No. R1326208P1_1 to G4S Secure Solutions (USA) Inc., for an initial three year term in the amount of $16,289,114, and authorized the Director of Purchasing to renew the Agreement for two one-year periods for a total five-year not-to-exceed amount of $30,310,231, which includes $2,755,476 in optional services.

 

On March 15, 2019, the Director of Purchasing executed the First Amendment to the Agreement increasing the contract pricing in order to increase compensation resulting from the December 11, 2018 amendment to the Living Wage Ordinance (Item No. 26) in the amount of $264,961 for a total five year not-to-exceed amount of $30,575,192.

 

The Director of Purchasing has exercised the initial term renewal and subsequent one-year renewals to extend the Agreement through Year Five which terminated on November 9, 2020. A 90-day extension for the period November 10, 2020 to February 9, 2021 will be effective per Section 3.1.1 of the original contract which provides for the Director of Purchasing to unilaterally extend the agreement or renewal period for 90 days beyond the termination date.

 

An extension to the Agreement will be necessary for the period February 10, 2021 to December 31, 2021 to provide additional time to complete the procurement process for the replacement contract while ensuring essential services are not disrupted.

 

In addition to release of the $2,755,476 in optional services to the overall contract threshold, an increase to the contract threshold in the amount of $1,610,063 is needed to facilitate services during the extension period. This increases the estimated not-to-exceed amount from $30,575,192 to $32,185,254.

 

Negotiations were held on October 5, 2020 and October 8, 2020 with representatives from the Facilities Management Division and G4S Secure Solutions (USA) Inc. The negotiations resulted in the proposed Second Amendment (Exhibit 1). The Amendment’s increased pricing is based on the negotiated cost of living adjustment of 1.50% over the Contractor’s historical pricing, and implementation of the February 12, 2019 Living Wage Amendment that will increase the health benefit component from $1.65 per hour to $3.44 per hour, an increase of 108.48% to the health benefit component. The increase in contract threshold is attributable to increased demand in Year Five for services related to COVID-19 activities and overall increased demand from Broward County using agencies.

 

The Office of Economic and Small Business Development established a County Business Enterprise (CBE) participation goal for this Agreement of 10%. As of November 4, 2020, G4S Secure Solutions (USA) Inc. (“G4S”) participation was 11.93% (Exhibit 2).

 

The Second Amendment has been reviewed and approved as to form by the Office of the County Attorney.
