Summary Explanation/Background

PUBLIC WORKS DEPARTMENT/HIGHWAY CONSTRUCTION AND ENGINEERING DIVISION RECOMMENDS APPROVAL.

 

Broward County is currently working with the Florida Department of Transportation (FDOT) to construct a two-lane Port Everglades by-pass road along Spangler Boulevard from east of SR-5/US-1/SR-A1A to Eisenhower Boulevard and along Eisenhower Boulevard from Spangler Boulevard to north of SE 20th Street. The road improvements also include two bridges, signage and pavement markings, signalization, lighting, port security checkpoint, and intelligent transportation systems infrastructure.

 

Approval of the agreement will provide County Incentive Grant Program funding from FDOT for design services of the new Port Everglades by-pass road project. Under this agreement, FDOT will fund a portion of the estimated cost of $2,500,000 to prepare the design plans and contract documents for the project, up to a maximum participation amount of $1,025,017. The County will fund the remaining project cost. The agreement also requires the County to guarantee payment of all just claims for materials, supplies, tools, labor and other just claims; and indemnify, defend, and hold harmless FDOT against any actions, claims, or damages arising out of, relating to, or resulting from any negligent or wrongful acts by the County.

 

Currently, County staff is finalizing an agreement with a consultant to provide design services for this project. Upon completion of the design and before advertising the project for construction, FDOT is expected to enter into a second agreement with the County to fund 50% of the construction and inspection services cost, up to a maximum participation amount of $11,463,725. At the appropriate time, staff will present this second agreement for the Board of County Commissioners’ consideration and approval.

 

The agreement has been reviewed and approved as to form by the County Attorney’s Office.

The source of funding is the Constitutional Gas Tax Capital Projects Fund in the estimated amount of $2,500,000. The Florida Department of Transportation will reimburse the County up to a maximum participation amount of $1,025,017 of the design cost through the State-Funded Grant Agreement-County Incentive Grant Program.
