Why Action is Necessary

In accordance with the Broward County Procurement Code, Section 21.31.a.4, Award Authority, Board approval is required for awards exceeding $500,000 that includes a single bidder, rejection of apparent low bidder, or protested award.

The purpose of this contract is to provide transportation services for the Greater Fort Lauderdale Convention & Visitors Bureau.

Summary Explanation/Background

THE PURCHASING DIVISION AND THE GREATER FORT LAUDERDALE CONVENTION & VISITORS BUREAU RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

The Office of Economic and Small Business Development (OESBD) did not assign Small Business Enterprise (SBE) or County Business Enterprise (CBE) goals for this project because there were no subcontracting opportunities for SBE or CBE contractors.  This item was previously scheduled for Board action on September 10, 2020; however, the item was pulled for further staff review.  OESBD conducted additional outreach to determine if there were any SBE or CBE firms that could participate in this solicitation, their outreach supported the original determination of no assignment of goals (Exhibit 2).

 

The purpose of this contract is to provide all labor, material, equipment, services, and incidentals required for transportation services for airports, the Convention Center, and tri-county destinations for the Greater Fort Lauderdale Convention & Visitors Bureau (GFLCVB) and various other Broward County agencies.

 

This Agreement includes covered services, in accordance with Broward County Living Wage Ordinance, Section 26-102(k). Fort Lauderdale Transportation, Inc. has agreed to be bound to the contractual obligations. The two-year term and potential estimated amount include the Living Wage health care benefit increase effective January 1, 2021.

 

The GFLCVB has reviewed the bid submitted by Fort Lauderdale Transportation, Inc. dba USA Transportation and concurs with the recommendation for award (Exhibit 3). Two vendor performance evaluations have been completed for Fort Lauderdale Transportation, Inc.; the firm has an overall rating of 4.03 out of a possible rating of 5.0.

 

The Purchasing Division has researched the prices submitted by Fort Lauderdale Transportation, Inc. and determined that the prices submitted are fair and reasonable (Exhibit 4). The actual usage for the initial term is anticipated to be far less than estimated because of COVID-19.

 

The Director of Purchasing has determined Phoenix Bus Inc. to be non-responsive; the bidder failed to respond to repeated requests for documentation required by the solicitation. The missing documentation includes: State and local operating permits, driver’s license(s), proof of vehicle ownership or current lease, dated pictures of vehicles, Broward County Chauffeur’s Registration, Lobbyist Registration Requirement Certification Form, and Certificate of Insurance.

 

The Director of Purchasing has determined FloridaTours.com to be non-responsible; the bidder lacks the vehicles required by the solicitation.

 

The Director of Purchasing has determined three bidders - GoPegasus, Elite Transport, and Academy Bus - to be non-responsive; the bidders failed to bid on all line items as required per Solicitation.

 

The bid posted on January 31, 2020 and opened on February 28, 2020; four bids and three partial bids were received with one declination (Exhibit 1).

 

There was no protest or appeal filed regarding this procurement.

 

Incumbent: FloridaTours.com; Contract Number and Title: TRN2115833B1, Bus or Large Vehicle Transport. Contract Term: March 19, 2018 through March 18, 2020. Expenditures to date: $255,000.

 

Incumbent: Fort Lauderdale Transportation, Inc.; Contract Number and Title: S2113884Q1, Transportation for Airports, Convention Center, and Broward County Destinations. Contract Term: May 11, 2017 through August 10, 2020. Expenditures to date: $81,810.
