Summary Explanation/Background

THE TRANSPORTATION DEPARTMENT AND THE PUBLIC WORKS DEPARTMENT RECOMMEND APPROVAL.

 

This item supports the Board's Vision and Value of "Cooperatively Delivering an Efficient and Accessible Regional Intermodal Transportation Network."

 

In compliance with federal regulations, this public hearing will allow public comment on the Broward County 2020-2023 Title VI Program.

 

Title VI of the Civil Rights Act of 1964 protects people from discrimination based on race, color, and national origin in programs and activities receiving federal financial assistance.

 

Broward County is a direct recipient of Federal Transit Administration (FTA) financial assistance through its Transportation Department and a sub-recipient of Federal Highway Administration (FHWA) funds from the Florida Department of Transportation (FDOT) through its Public Works Department.

 

In accordance with Title VI of the Civil Rights Act of 1964, Federal Transit Administration (FTA) Circular 4702.1B, “Title VI and Title VI-Dependent Guidelines for Federal Transit Administration Recipients,” dated October 1, 2012, transit providers, as direct recipients of FTA funds, are required to submit Title VI program updates once every three years (triennial basis) to the FTA.

 

The USDOT, Federal Highway Administration’s (“FHWA”) Title VI regulations, 23 CFR 200, provides guidelines for compliance with FHWA Title VI requirements to State highway agencies that receive financial assistance from the FHWA. The Florida Department of Transportation (FDOT) is the primary recipient of Federal funds. Pursuant to 23 CFR Part 200 and to maintain Local Agency Program (LAP) Certification, Broward County is required to document its compliance (re-certify) with Federal and State nondiscrimination authorities, including Florida Statutes; US Department of Justice, US Department of Transportation (USDOT), and Federal Highway Administration (FHWA) regulations once every three years or at the request of FDOT or FHWA.

As part of the Broward County 2020-2023 Title VI Program, and in compliance with FTA requirements, the following elements will be considered for public comment, as well as review and approval by the Board of County Commissioners:
